first responders helping an injured pedestrian at a Tampa crosswalk

You Did Everything Right. Then a Driver Changed Everything.

One moment, you were walking. Maybe crossing the street. Maybe stepping off a curb. The next — sirens, pain, panic. Pedestrian accidents happen in seconds, but their impact can last a lifetime.

And while you’re dealing with injuries, lost work, and mounting bills, the driver’s insurance company is already looking for ways to deny responsibility.

At CDB Injury Law, we don’t let them get away with it. We step in quickly, we fight fiercely, and we make sure you’re treated like a person — not a liability.

Florida law, plainly

Your rights as an injured pedestrian

Drivers today are more distracted than ever — texting, rushing, rolling through stops. When they hit someone on foot, the law is often more on your side than the insurance adjuster wants you to believe.

You may be covered even though you weren’t driving

Florida’s no-fault system can reach pedestrians. If you’re hit by a car, PIP (Personal Injury Protection) — usually from your own auto policy, or a household member’s — can pay early medical bills regardless of who was at fault. If you don’t have PIP, the at-fault driver’s liability coverage is still in play.

Crosswalk or not, the driver still has a duty

Drivers must yield to pedestrians in marked crosswalks and exercise due care everywhere — including sidewalks, parking lots, and driveways. “I didn’t see them” is not a defense. Even if you weren’t in a crosswalk, you can still have a strong claim.

Florida’s deadlines and fault rules

Under Florida’s 2023 tort-reform law, you generally have two years from the crash to file, and if you’re found more than 50% at fault you recover nothing. Insurers lean hard on that rule to shift blame onto pedestrians — countering it with real evidence is where a case is won.

In the first days

What to do after being hit

1

Get medical care — and keep every record.

See a doctor even if you feel “okay.” Pedestrian-impact injuries often surface later, and the record from day one becomes the backbone of your claim.

2

Don’t let the driver’s insurer put words in your mouth.

Their adjuster may call fast and friendly, hunting for anything that shifts blame to you. You are not required to give a recorded statement — send them to us.

3

Preserve the evidence before it’s gone.

Surveillance and traffic-camera footage, signal-timing data, and witness memories fade quickly. We move fast to secure scene analysis, camera footage, and the accident report.

4

Talk to a lawyer before you accept anything.

The first offer is almost never the real value of a pedestrian case. Leveling the field early is the single biggest thing you can do.

Tampa, specifically
#1 danger zone

The Tampa–St. Petersburg metro has repeatedly ranked among the most dangerous places in the country to walk. Wide, fast arterial roads and heavy traffic mean pedestrians here are hit — and hurt — at rates well above the national average.

Frequently asked

Pedestrian accident questions

What should I do right after a pedestrian accident?
Get medical attention, call the police so there’s an official report, and photograph the scene if you safely can — the crossing, signals, and vehicle. Get witness names. Don’t discuss fault with the driver’s insurer, and call a lawyer before giving any statement.
I was hit in a parking lot — is that different?
No. Drivers backing up or pulling out still owe you a duty of care. Many pedestrian injuries happen in lots and driveways, and those cases are very much winnable.
Does my own car insurance help if I was walking?
Often, yes. Your PIP (and sometimes uninsured-motorist) coverage can apply even when you’re on foot and struck by a vehicle. We sort out every source of coverage available to you.
How much is my pedestrian case worth?
It depends on your injuries, treatment, lost income, and how fault shakes out — there’s no honest one-size number. What we can say is the insurer’s first offer is almost never the real value, and we bring in experts to prove the full picture.
Is there a deadline to file?
In Florida you generally have two years from the date of the crash (since the 2023 tort-reform law). Waiting is risky, though — camera footage and witness memories fade fast.
